Agency StatementSuncape Accommodations (SUNCAPE) acts in all cases as an agent and not as a principal in any agreement to rent accommodation. A contract will exist between the accommodation seeker (CLIENT) and the accommodation provider (PROVIDER).
The following terms and conditions may vary in the case of very special circumstances, e.g. low budget accommodations like backpackers could have more favourable cancellation charges. Please note that any variation would be highlighted on the web page describing the respective accommodation.
BookingsAll reservations will be made on request, except in cases where SUNCAPE and the PROVIDER have made any arrangements to work on allocations.
A legally binding contract will only be formed when SUNCAPE either sends electronic confirmation of an online booking to the CLIENT or, when the booking is not made online, SUNCAPE confirms the booking via phone/fax. SUNCAPE will thereafter dispatch written confirmation of the booking to the CLIENT.
Reservations and paymentsIn order to confirm a booking, the CLIENT must pay a deposit by credit card or direct deposit, representing a proportion of the purchase price. The proportion of the purchase price required by way of deposit will vary according to the type of accommodation purchased. The balance of the price shall become payable upon receipt of the final payment demand, in accordance with the terms therein, usually prior to the check-in date. In the event that the balance of the price has not been received by SUNCAPE, by the due date, SUNCAPE may cancel the booking and shall not be liable to make any refund to the CLIENT of any deposit received in respect of such cancelled reservation (check cancellation charges).
A legally binding contract will only be formed when SUNCAPE either sends an electronic confirmation of the CLIENT's online booking to the CLIENT or, when the CLIENT's booking is not made via the Internet, SUNCAPE confirms the booking via phone/fax. SUNCAPE will thereafter dispatch written confirmation (email/fax) of the booking to the CLIENT.
Booking changes, cancellations and refunds
Please note that the cancellation charges could be reduced notably if the PROVIDER succeeds in reselling (part of) the cancelled period. However, SUNCAPE cannot guarantee a refund till a payment from the PROVIDER has been received.
PROVIDER, airlines and other: Cancellation, changes in scheduleSUNCAPE shall not be under any liability to the CLIENT if due to circumstances beyond its control.
AgesThe age of children relates to the whole of the period when they are staying including the day of departure. If a child's birthday occurs during the holiday including the date of departure then the new age must be stated. The accommodation may be refused if the date of birth according to the child's passport is different to that on the booking.
Health & SafetyOnline medical advice for travellers can be found at www.doh.gov.uk. Otherwise, for medical advice regarding your journey, please contact your GP or the Department of Health. The Foreign and Commonwealth Office (FCO) issues up to date information on safety issues for many countries world-wide: www.fco.gov.uk/travel.
JurisdictionAll agreements will be made in South Africa, Cape Town and be governed by South African law and be subject to the exclusive jurisdiction of the South African Courts of Cape Town.
LiabilitySUNCAPE cannot be held liable for any errors or omissions contained within this site, or for damages, direct or consequential. The PROVIDER will be held fully responsible for the information listed.
The CLIENT and not SUNCAPE will be liable for damages caused to the accommodation.
A (travel) liability insurance is strongly recommended. Its cost is very low at about US-$ 30 to 60 per year.

Passports & VisasPlease ensure that passports and any necessary visas are valid for the entire trip. If you fail to do so, carriage may be denied and the CLIENT will be solely responsible for any costs, losses or damages which the CLIENT, SUNCAPE and other travel partners incur as a result of your failure to obtain the relevant documentation and inoculations. Some countries require passengers to have at least six months validity remaining on a passport. Visas may also be required for longer stays over three months. For up to date advice on immigration and visa requirements please contact the embassy, high commission or consulate of the CLIENT's destination.

Changes to terms & conditionsSUNCAPE reserves the right to change its booking terms and conditions at any time.
